1. Agreement to Terms

By accessing or using Affilify's website, platform, and services (the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service.

2. Description of Service

Affilify provides a software-as-a-service platform for managing affiliate marketing programs, including but not limited to affiliate tracking, commission management, payout processing, and reporting tools.

3. Account Registration

• You must provide accurate, complete, and current registration information.
• You are responsible for safeguarding your account credentials.
• You must be at least 18 years old to create an account.
• You are responsible for all activity under your account.

4. Subscription Plans & Billing

• Paid plans are billed monthly or annually at the rates published on our Pricing page.
• All fees are non-refundable except as required by law or our refund policy.
• We reserve the right to modify pricing with 30 days' notice.
• Downgrading your plan may result in loss of features or data associated with higher-tier plans.

5. Acceptable Use

You agree not to:

• Use the Service for any illegal purpose or violation of applicable laws
• Engage in or facilitate click fraud or conversion fraud
• Attempt to reverse-engineer, decompile, or disassemble the Service
• Interfere with or disrupt the integrity or performance of the Service
• Use the Service to send spam or unsolicited communications
• Violate any intellectual property rights

6. Intellectual Property

The Service, including all content, features, and functionality, is owned by Affilify and protected by copyright, trademark, and other intellectual property laws. You retain ownership of your data and content uploaded to the Service.

7. Data & Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of information as described therein.

8. Service Availability

We strive for 99.9% uptime but do not guarantee uninterrupted service. We are not liable for any downtime, errors, or data loss. Scheduled maintenance will be communicated in advance when possible.

9. Limitation of Liability

To the maximum extent permitted by law, Affilify shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from your use of the Service.

Our total liability for any claims under these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Affilify and its officers, directors, employees, and agents from any claims, losses, liabilities, damages, costs, or expenses arising from your use of the Service or violation of these Terms.

11. Termination

• You may cancel your account at any time through your account settings.
• We may suspend or terminate your account for violations of these Terms.
• Upon termination, your right to use the Service ceases immediately.
• We will make your data available for export for 30 days after termination.

12. Modifications to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or in-app notification at least 30 days before they take effect.

13. Governing Law

These Terms are governed by the laws of the State of California, USA, without regard to conflict of law principles. Any disputes shall be resolved in the courts of San Francisco County, California.
